General Terms and Conditions

Beyond Hype Social Version 1.0, effective 1 November 2026

These are the general terms and conditions (algemene voorwaarden) for working with Beyond Hype Social. We've tried to keep them clear and fair. If anything is unclear, just ask us at hello@beyondhypesocial.com before you sign.

1. Who we are

Beyond Hype Social is a trade name of Jenny Strandberg Creative, a sole proprietorship (eenmanszaak) based in the Netherlands.

KvK number: 94442207

VAT/BTW number: NL005084058B03

Address: our registered address is recorded with the Dutch Chamber of Commerce (KvK) and is available on request.

General enquiries: hello@beyondhypesocial.com

In these terms, "we" and "us" means Jenny Strandberg Creative, trading as Beyond Hype Social. "You" or "the client" means the business or person who asks us for a quote or hires us.

2. When these terms apply

2.1 These terms apply to every quote, proposal and agreement between us and you for our services.

2.2 We give you these terms before or when we make an agreement: we attach them to our quote and they are also available on our website to read, download and save. If you'd like a copy at any time, ask and we'll send one free of charge.

2.3 Your own general terms don't apply unless we've agreed to them in writing.

2.4 Anything we agree in writing in a quote or agreement takes priority over these terms where they differ.

2.5 If any part of these terms turns out to be invalid, the rest still applies. We'll replace the invalid part with a valid one that comes as close as possible to what was intended.

3. Quotes

3.1 Our quotes are valid for 30 days from the date on the quote, unless the quote says otherwise.

3.2 Prices on our website and in quotes are in euros and exclude VAT, unless stated otherwise.

3.3 Our quotes are based on the information you give us. If that information turns out to be incomplete or changes, we may adjust the quote.

3.4 An obvious mistake or typo in a quote or on our website doesn't bind us.

4. How an agreement is made

4.1 An agreement starts when you accept our quote in writing, for example by signing it or confirming by email, or when we start the work at your request.

4.2 Changes to the agreement only apply once we've both confirmed them in writing (email is fine).

5. Our services

5.1 We offer social media management for businesses, including:

  • Foundation: a one-off audit, strategy and content pillars, €2,500.

Mini Foundation: a shorter one-off version, €1,250, available together with a Boost or Full plan.

Monthly plans: Launch €750, Boost €1,500, Full €4,500 per month.

Extra platforms: Launch +€150, Boost +€300, Full +€500 per extra platform per month. Instagram and Facebook together count as one platform.

5.2 The exact scope of each package (for example the number of posts, reels or stories, and which platforms) is set out in the quote. Work outside that scope is extra and we'll always agree it with you first.

5.3 Ad spend and ad management are not included in any package. They're always quoted and billed separately (see Article 13).

5.4 We do our work carefully and professionally, to the best of our ability. Our commitment is to do the work well (an inspanningsverplichting). We can't promise a specific result (see Article 12).

5.5 Fit calls before an agreement are always free and don't commit you to anything.

5.6 We may involve trusted freelancers or other third parties to help with the work. We stay responsible for the work towards you and make sure they keep your information confidential.

6. What we need from you

Good content is teamwork. To deliver on time, we need you to:

give us accurate information about your business, brand, audience and goals

  • share brand materials, product information, photos, videos and logos we need, on time

  • give us the account access agreed in the quote, preferably through the platform's partner or role features (such as Meta Business Suite)

make sure you have the rights to all materials you give us, and that they don't break any law or anyone else's rights

tell us in good time about anything relevant, such as launches, promotions, sensitive topics or legal rules in your industry

reply to questions and approval requests within 3 working days

If something we need arrives late or not at all, our deadlines move with it. Extra time this causes may be charged at our usual rates, after we've told you. Monthly fees still apply for the period in which we were ready to work.

7. Approving content

7.1 We share planned content with you for approval before it's posted, in the way agreed in the quote (for example a content calendar or a shared folder).

7.2 Each content item includes 1 round of revisions. Foundation deliverables include 2 rounds. Extra rounds, or changes after approval, may be charged.

7.3 Once you approve content, you're responsible for it being accurate and suitable for your business, including claims about your products or services and any industry rules that apply to you.

7.4 If we don't hear from you within 3 working days after an approval request, we'll send a reminder. We won't post content you haven't approved unless we've agreed in writing that we may (for example for everyday stories or community replies).

7.5 You can always ask us to remove a post. We'll do so as soon as reasonably possible.

8. Payment

8.1 Monthly plans are invoiced monthly in advance, at the start of each month. Foundation and Mini Foundation are invoiced 50% when the agreement is signed and 50% on delivery.

8.2 Invoices must be paid within 14 days of the invoice date.

8.3 If you're a business and an invoice isn't paid on time, you're in default (in verzuim) without needing a reminder. We may then charge the statutory commercial interest (wettelijke handelsrente, art. 6:119a Dutch Civil Code) from the due date, and the statutory collection costs (at least €40).

8.4 If you're a consumer, we'll first send you a free reminder giving you at least 14 days to pay. After that we may charge the statutory interest (wettelijke rente) and collection costs within the legal limits.

8.5 If payment is late, we may pause our work after letting you know, until the invoice is paid.

8.6 If you disagree with an invoice, please tell us within 14 days. You must still pay the part that isn't in dispute.

9. Price changes

9.1 We may change our prices once a year, with at least 30 days' written notice. Price changes don't apply to the current minimum term of a running agreement.

9.2 If the increase is more than the inflation figure (CPI) published by Statistics Netherlands (CBS), you may end the agreement from the date the new price takes effect.

9.3 Changes in VAT or other taxes are always passed on.

10. Term and ending a monthly plan

10.1 Monthly plans have a minimum term of 3 months, starting on the date in the quote.

10.2 After the minimum term, the plan continues month by month. Either of us can end it with 1 calendar month's notice, in writing (email is fine).

10.3 Foundation and Mini Foundation are one-off projects. They end when we deliver them.

10.4 Either of us can end the agreement straight away, in writing, if the other:

  • seriously fails to meet its obligations and doesn't fix this within 14 days after a written request

  • goes bankrupt, is granted a suspension of payments, or stops trading

10.5 Your safety and ours matter. We can pause or stop our services straight away, in writing, if we reasonably feel that we or anyone working with us is unsafe, or is being harassed, threatened, intimidated or treated in a discriminatory or otherwise inappropriate way. This applies to conduct by you, your staff or anyone acting for you, whether in person, on a call, by message or online. We can also decline any meeting, shoot or location we don't consider safe. If we stop for this reason, you pay for the work already done. We don't owe you any compensation, and the minimum term and notice period don't apply.

10.6 When the agreement ends:

you pay for the work done and the period up to the end date

  • we hand back or remove our access to your accounts within 14 days, and you change any passwords you shared

we don't schedule new posts after the end date

11. Intellectual property and use of content

11.1 We (or our licensors) keep the copyright and other intellectual property rights in everything we create, such as posts, reels, captions, graphics, strategies and templates, unless we agree otherwise in writing.

11.2 Once you've paid the related invoices in full, you get a non-exclusive, perpetual licence to use the content we made for you for your own business, on any channel. You can keep using the content after the agreement ends. Until those invoices are paid in full, you may not use the content.

11.3 Raw footage, working files and templates aren't included unless agreed in the quote. They're available on request for a fee.

11.4 You keep all rights in the materials you give us. You give us permission to use them to deliver our services.

11.5 Stock material, music and fonts are licensed from third parties under their own terms. On social platforms, music from the platform's library may only be licensed for use on that platform.

11.6 You may not resell our strategies, frameworks or templates or pass them on to third parties as your own.

12. Platforms, reach and results

12.1 Our work depends on platforms like Instagram, Facebook, TikTok and LinkedIn, which are owned by third parties. They can change their algorithms, features, rules and policies at any time, or suspend accounts. We have no control over this and aren't liable for its effects.

12.2 We can't guarantee specific reach, followers, engagement, leads or sales. We'll share what we see in the data and advise you on how to improve.

12.3 We follow the platforms' rules to the best of our knowledge. You stay responsible for your account and for complying with laws that apply to your business, such as advertising and consumer rules.

13. Advertising and ad spend

13.1 Ad spend (the budget paid to Meta or other platforms) is always paid by you, preferably directly to the platform with your own payment method.

13.2 Ad management is billed separately from our packages, based on a separate quote.

13.3 You decide on and approve ad budgets. We aren't liable for ad spend, rejected ads or account restrictions imposed by a platform, unless they are caused by our intent or gross negligence.

14. Portfolio and showing our work

We'd love to show the work we've made together. We only use your content, name or logo in our portfolio, on our website or on our social media with your consent. You can give or withdraw this consent at any time by emailing us. Withdrawing it doesn't affect material that was already published before you told us, but we'll remove it from our own channels where reasonably possible.

15. Confidentiality

15.1 We both keep confidential information confidential. This includes business plans, unpublished launches, results, prices, login details and anything marked or reasonably understood as confidential.

15.2 This doesn't apply to information that's already public or that we must share by law.

15.3 This duty continues after the agreement ends.

16. Personal data

16.1 How we handle personal data is explained in our Privacy Policy on our website.

16.2 Where we process personal data on your behalf, for example comments or messages from your followers in accounts you give us access to, you're the controller and we're the processor. We'll sign a data processing agreement (verwerkersovereenkomst) with you, as required by the GDPR (AVG).

17. Liability

17.1 If we make a mistake, please tell us straight away so we can fix it. We'll always first try to put things right.

17.2 Our total liability is limited to the amount we invoiced you for the work in the 3 months before the damage occurred. In any case it is never more than the amount our business liability insurance pays out in that case.

17.3 We aren't liable for indirect damage, such as lost profit, lost revenue, missed savings, reputational damage or business interruption.

17.4 We aren't liable for damage caused by:

  • incorrect or incomplete information or materials you gave us

  • content you approved

  • decisions or changes by social media platforms (see Article 12)

your own use of your accounts or shared passwords

17.5 These limits don't apply if the damage is caused by our intent (opzet) or gross negligence (bewuste roekeloosheid). Nor do they limit any rights a consumer has by law.

17.6 Any claim for damages must be made in writing within 12 months after you discovered the damage, or could reasonably have discovered it.

17.7 You indemnify us against claims from third parties (for example about copyright or the content of posts) that relate to materials you gave us or content you approved, unless the claim is caused by our intent or gross negligence.

18. Force majeure

We're not responsible for delays or failures caused by circumstances beyond our reasonable control, such as illness, platform outages, account suspensions by platforms, internet or power failures, or extreme weather. We'll let you know as soon as possible. If the situation lasts longer than 60 days, either of us may end the agreement in writing. You pay for work already done.

19. Complaints

19.1 Not happy with something? Please tell us within 14 days after delivery, or after you noticed the problem, by email to info@jscreative.pro. Describe what's wrong as clearly as you can.

19.2 We'll reply within 2 working days and aim to find a solution together, for example by revising the work.

19.3 A complaint doesn't put your payment obligations on hold, except for the part that's genuinely in dispute.

20. Changes to these terms

We may update these terms from time to time. The new version applies to new agreements. For running agreements, we'll tell you at least 30 days before a change takes effect. If a change is to your disadvantage, you may end the agreement from that date.

21. Law and disputes

21.1 Dutch law applies to these terms and to all agreements with us. The UN Convention on Contracts for the International Sale of Goods (CISG) doesn't apply.

21.2 We'll always try to solve a disagreement together first.

21.3 If we can't, the dispute will be decided by the District Court of The Hague (Rechtbank Den Haag), the Netherlands. If you're a consumer, you may instead choose the court that would normally have jurisdiction where you live.

22. Language

These terms are written in English. If they're translated, the English version prevails if there's any difference.

23. If you're a consumer

Our services are aimed at businesses. If you hire us as a private individual and not for your business or profession (a consumer), the mandatory consumer protection rules of Dutch and EU law always apply, and nothing in these terms limits them. In particular:

Right of withdrawal (herroepingsrecht). If we made the agreement at a distance (for example online, by email or by phone), you can cancel it within 14 days of making it without giving a reason. Just email us at info@jscreative.pro.

If you ask us to start work within those 14 days and then cancel, you pay a fair share for the work we've already done.

  • If you've expressly asked us to start and confirmed that you'll lose the right once the work is fully done, the right of withdrawal ends when we've fully completed the service.

  • After any minimum term, a monthly plan for a consumer can always be ended with a maximum of one month's notice.

  • If you're in the EU, you can also contact the European Consumer Centre Netherlands (ECC-Netherlands) for advice.
